Terms of Service

We may revise these Terms at any time at our discretion — for example, to reflect changes in features, technology, applicable law, or how we operate. Where required by law, we'll provide notice of material changes through the Service or by other reasonable means. Unless stated otherwise, revised Terms take effect once posted. Your continued use of the Service after any update indicates your acceptance of the new Terms.

We may also modify, suspend, or discontinue the Service — or any part of it — at any time, with or without notice, and without liability to you, to the extent permitted by applicable law.

All elements of the Service — including software, algorithms, AI models, interfaces, designs, text, graphics, logos, and trademarks — are owned by us or our licensors and protected under applicable intellectual property laws, except for User-Generated Content.

We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial purposes only, provided you comply with these Terms.

You receive no rights beyond those explicitly described here. Unauthorized use of the Service may result in termination of access and potential legal action.

Who Can Use the Service

The Service is intended solely for individuals who meet the minimum age requirement under applicable law (generally 18 years old). Access by anyone below this age is strictly prohibited.

If you are 18 or older but have not yet reached the age of legal majority in your jurisdiction, you may only use the Service with the involvement, consent, and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

Zero-Tolerance Policy on Child Safety

NovaVid maintains an absolute zero-tolerance stance on Child Sexual Abuse Material (CSAM) and all forms of child exploitation. Although our Service is designed for personal content creation, using our AI tools and workflows to generate, edit, or process any content that sexualizes minors — real, fictional, generated, implied, or suggested — is strictly forbidden.

By using the Service, you acknowledge and agree that:

• Prohibited Content: You will not use the Service to input, generate, or output any material depicting children in a sexualized context or relating to child exploitation, abuse, or endangerment.
• No Distribution: Even though the Service does not include in-app social sharing, creating CSAM via our tools for storage or distribution elsewhere violates these Terms and applicable law.

Technical Safeguards

Safety is built into the Service by design. Our Service runs on pre-set, curated templates and guided creation flows — not an open-ended, unrestricted content generation platform. These workflows are specifically designed and tested to prevent the creation of material that depicts minors in compromised or sexualized scenarios.

• AI Partner Compliance: We work with leading AI providers and rely on their safety filters and content moderation APIs to automatically detect, block, and reject violating inputs.
• Monitoring & Reporting: We do not access private content stored locally on your device. However, automated safety systems may apply signals during upload, processing, or generation. Suspected CSAM-related activity may result in enforcement action and reports to NCMEC and/or law enforcement where required by law.
• Permanent Bans: Anyone found attempting to jailbreak, reverse-engineer, or circumvent our safeguards to generate CSAM will be permanently banned without notice.

You may only use the Service for lawful purposes and in accordance with these Terms. The following conduct is prohibited, including but not limited to:

• Violating any applicable law, regulation, or court order;
• Uploading, generating, or processing content that is illegal, misleading, abusive, obscene, hateful, violent, harassing, defamatory, or otherwise prohibited under these Terms;
• Infringing or misappropriating the intellectual property, privacy, publicity, or other rights of any person or entity;
• Circumventing, disabling, or interfering with any technical safeguards, security mechanisms, or usage limits;
• Reverse engineering or decompiling the Service, or attempting to extract source code or underlying models, except where expressly permitted by law;
• Using bots, scrapers, or automated systems to access or collect data from the Service without prior written permission;
• Uploading malware, viruses, or harmful code, or using the Service to distribute spam;
• Sharing your account credentials or allowing others to access the Service through your account;
• Any other conduct that violates applicable laws, App Store policies, or other known regulatory requirements.

You may upload or submit images and videos through the Service ("User-Generated Content" or "UGC"). You retain ownership of your UGC, subject to the licenses described here.

The Service provides access to pre-set, curated templates and workflows only — it is not a social network or content-sharing platform. Processed outputs may be downloaded for your personal use, but the Service does not support in-app publishing or sharing of UGC with other users.

By submitting UGC, you grant us a limited, non-exclusive license to host, process, transmit, and temporarily store such content solely for operating, maintaining, and improving the Service. We do not use your UGC to train machine learning models unless you provide explicit consent, as further described in our Privacy Policy.

You are solely responsible for your UGC and represent that you hold all necessary rights, permissions, and consents to submit and process it through the Service.

Certain features of the Service rely on automated, algorithmic, or AI-based processes ("AI Features"). Content you provide ("Input") and content produced by the Service ("Output") are treated as User-Generated Content under these Terms.

Output Limitations

AI-generated Outputs are produced automatically and may contain errors, inaccuracies, or unexpected results. Outputs may not be unique and could resemble results generated for other users. You should review and independently verify any Output before relying on it.

The Service does not provide professional, legal, medical, or other regulated advice. You agree not to rely on Outputs for decisions requiring professional judgment, and you use all Outputs at your own risk.

Content Safety, Withheld Results & Credit Restoration

We use automated measures to detect and prevent generation or display of content that may violate these Terms, including objectionable material. If a request or result is flagged, we may display an in-app notice and withhold the result from being shown.

Where applicable and as described in-app, if a result is withheld due to automated safety enforcement or a technical error, we may restore the Gems used for that generation to your in-app balance. Such restoration is not a cash refund and does not entitle you to any monetary refund.

Template pages and generated-result pages include a visible "Report" button so you can flag objectionable content.

Available Purchase Options

Paid features may be accessed through:

• Auto-renewing subscriptions that provide ongoing access to certain features or usage allowances; and
• One-time or consumable purchases, such as in-app credits or usage tokens ("Gems").

All payments are processed through the platform from which you downloaded the App — either the Apple App Store or Google Play — and are subject to that platform's terms and policies. Pricing, billing intervals, and available offerings may vary by region and will be disclosed at the time of purchase.

Auto-Renewal

Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. For App Store purchases, cancellation must be made at least 24 hours before the end of the current billing period. For Google Play purchases, you may cancel at any time; cancellation takes effect at the end of the current paid period and you retain access until then. Deleting or uninstalling the App does not cancel an active subscription on either platform.

Managing Subscriptions

You can manage, modify, or cancel your subscription through the account settings of the platform where you made your purchase:

• Apple App Store: Manage subscriptions via your Apple ID account settings.
• Google Play: Manage subscriptions via the Google Play app or your Google account.

Refund Policy

All refund requests for cash purchases must be submitted directly to the platform through which you made your purchase. We are unable to issue cash refunds directly for purchases made through either the Apple App Store or Google Play.

• Apple App Store: Refunds are handled by Apple under their applicable policies.
• Google Play: Refunds are handled by Google under their applicable policies. Past subscription periods are generally non-refundable. Unauthorized charges may be eligible for a refund if reported within 120 days of the transaction date.

We may, at our sole discretion, restore or credit Gems to your in-app balance in certain situations (such as when a result is withheld due to automated safety enforcement, suspected policy violations, or technical errors). Any such credit has no monetary value outside the Service, is non-transferable, and may be subject to additional conditions.

Final Sales on Consumables

Unless required by applicable law, all purchases of consumable in-app products (including Gems, credits, or usage tokens) are final and non-refundable once completed, including any unused portion. Fees paid for a current subscription period are generally non-refundable, and we do not offer partial credits for unused time in an active billing period.

Account Deletion & Asset Forfeiture

You may delete your account at any time via the Account settings page. Upon deletion, any unused assets — including active subscriptions or unconsumed Gems — are immediately voided and cannot be recovered. Account deletion is permanent and irreversible. No refunds are provided for unused assets after deletion, except where required by applicable law.

Your use of the Service is governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal data.

If you are located in the European Economic Area, the United Kingdom, or Switzerland, the GDPR applies to your data. You have rights including access, rectification, erasure, restriction, objection, and data portability.

If you are a California resident, the CCPA applies. You have the right to know what personal information we collect, request its deletion, and opt out of certain data practices where applicable.

To exercise any applicable rights, please follow the process described in our Privacy Policy. We will respond in accordance with applicable law.

The Service is provided on an "as is" and "as available" basis, without warranties of any kind — express, implied, or statutory — to the maximum extent permitted by law.

We disclaim all implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free from harmful components, or that any Output will meet your specific expectations or requirements.

To the fullest extent permitted by applicable law, we will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages — including loss of profits, data, or goodwill — arising from or related to your use of or inability to use the Service.

Our total cumulative liability for any claim under these Terms will not exceed the greater of: (a) the amount you paid us for the Service in the 12 months preceding the event giving rise to the claim, or (b) USD $100, unless otherwise required by law.

You may stop using the Service at any time. We reserve the right to suspend or terminate your access — with or without notice — if you breach these Terms or if your continued access would expose us to legal or regulatory risk.

Upon termination, all licenses granted to you under these Terms will immediately end, and you must stop using the Service.
